How it Works | Eligibility

Eligibility

Eligibility for sound insulation is primarily determined by the location of a home relative to the FAA approved Noise Exposure Map, which was originally developed during the 1991 FAR Part 150 Noise Compatibility Study. An update of the Noise Compatibility Study is currently underway. One part of this Study Update will create a new FAA approved Noise Exposure Map for LVIA. This new Map will be available sometime during the Spring of 2004. Homes that fall within the 65 - 69 DNL contour on the current version of the FAA approved Noise Exposure Map for LVIA may be eligible for sound insulation under FAA guidelines. In addition to being located within the noise contours, however, several other criteria must also be met. These criteria include the following:

1. Application Form - Homeowner must complete an application to participate in the program. It is only necessary to complete an application once. Please click here if you are unsure if an application has been completed for your home.
2. Occupancy Permit Obtained Prior to 10/01/1998 - New homes constructed within the noise contour with a certificate of occupancy dated after 10/01/1998 are not eligible for sound insulation.
3. Building Code Compliance - The home must be free of building code violations that would interfere with the sound insulation construction or introduce unacceptable additional costs to the program. A preliminary survey will identify such violations and the homeowner will be notified in writing of the conditions that they will be required to meet prior to participating in the program.
4. Easement - The homeowner(s) must sign an Avigation Easement granting LVIA the right to flight over the residence and all concomitant results. The easement does not limit homeowners' rights in cases of negligence or accident.
5. Zoning - The property must also be zoned for residential use and must conform with this usage.
